Fared Platform User Agreement
This document forms a legally binding agreement between you and Fared, governing your use of the app and website to list distinguished plates, buy and sell them, and take part in auctions. Please read it carefully before using the service.

1. Preamble and Acceptance
1.1 This agreement is entered into between Fared — an entity duly registered in the Kingdom of Saudi Arabia, referred to hereafter as the "Platform" or "Fared" — and every person who uses the app or the website, referred to as the "User".
1.2 By using the Platform, creating an account, or clicking the acceptance option during registration, you confirm that you have read, understood and agreed to be bound by these Terms and by the Privacy Policy, which forms an integral part of them. If you do not agree to any provision, you must refrain from using the Platform.
1.3 Your electronic acceptance of these Terms constitutes a valid signature producing full legal effect under the Electronic Transactions Law of the Kingdom of Saudi Arabia.
1.4 This agreement is subject to the laws in force in the Kingdom, in particular the E-Commerce Law and its Implementing Regulations, the Personal Data Protection Law, the Anti-Cyber Crime Law, and the Traffic Law and its Implementing Regulations with respect to vehicle plates and ownership transfer procedures.
2. Definitions
Wherever used in this agreement, the following terms carry the meanings set out beside each of them, unless the context requires otherwise:
- Platform / Fared: the Fared app on the App Store and Google Play, its website, and all services, tools and interfaces provided through them.
- User: any natural or legal person who has created an account on the Platform or used its services, whether as a seller, buyer, bidder or visitor.
- Seller: the User who lists a plate they own for sale or auction on the Platform.
- Buyer: the User who submits a purchase offer or a bid on a listed plate.
- Plate: the vehicle plate issued by the competent authority in the Kingdom and listed for sale or auction on the Platform.
- Listing: the plate's display page and the letters, digits, category, city and asking price it contains.
- Auction: a time-limited competitive sale mechanism in which the plate is awarded to the highest bidder when the stated period ends.
- Transaction: the contract of sale concluded between Seller and Buyer through acceptance of an offer or winning an auction on the Platform.
- Escrow: the Platform holding the transaction value in its bank account in trust until ownership transfer is complete.
- Platform Fees: the consideration due to Fared for its intermediary services, as set out in Clause 8.
- Account: the profile created by the User on the Platform and the data and permissions associated with it.
- Business Day: any day other than Friday, Saturday and official public holidays in the Kingdom of Saudi Arabia.
3. Role of the Platform and Relationship Between Parties
3.1 Fared acts as a technical intermediary providing an electronic environment that brings sellers and buyers together, and offers a service holding funds in trust until ownership transfer is complete. Fared is in no case a seller or buyer of plates, nor an agent of either party to a Transaction.
3.2 The contract of sale is concluded directly between Seller and Buyer, and each bears responsibility for performing its own obligations. Fared is not a party to that contract and does not guarantee its performance, save within the limits of the escrow service set out in Clause 9.
3.3 Fared provides no investment advice and no binding valuation of plates. Any price index or market data displayed is indicative only and does not guarantee that any particular price will be achieved.
4. Eligibility, Registration and Accounts
- 4.1 To use the Platform, the User must be at least eighteen (18) years old and have full legal capacity to contract under the laws of the Kingdom.
- 4.2 The User undertakes to provide accurate, complete and current information on registration and to update it as soon as it changes. Providing inaccurate information constitutes a material breach of this agreement.
- 4.3 The information entered must match the identity of the account holder. Creating an account in another person's name or impersonating them is prohibited.
- 4.4 The Account is personal and non-transferable. The User alone is responsible for keeping login credentials confidential and for all activity carried out through the Account.
- 4.5 The User undertakes to notify Fared immediately upon suspecting any unauthorised use of their Account.
- 4.6 Fared may require identity verification before enabling the User to list, bid or receive proceeds, in order to meet customer verification requirements and prevent fraud.
- 4.7 A User may not hold more than one account without Fared's prior written consent.
5. Listing Plates: Seller Representations and Warranties
5.1 On publishing any Listing, the Seller represents and warrants that:
- They are the lawful owner of the listed plate and hold full legal authority to dispose of it.
- The plate is free of any seizure, pledge, dispute or legal impediment preventing transfer of its ownership.
- All Listing details are true, accurate and not misleading, including letters, digits, category and city.
- The plate is not listed on another platform in a manner that could result in it being sold twice, and no prior binding agreement has been concluded over it.
- Listing and selling the plate does not contravene the Traffic Law and its Implementing Regulations or any other law in force in the Kingdom.
- 5.2 Listing fictitious plates, plates not owned by the lister, or duplicating a single plate across multiple Listings is strictly prohibited.
- 5.3 The Seller bears full legal and financial responsibility for the accuracy of their Listing and shall indemnify Fared for any loss arising from its inaccuracy.
- 5.4 Fared may — without obligation — review Listings and reclassify, reject, remove or suspend any Listing that breaches these Terms, the law or public morals.
- 5.5 Fared's review or publication of a Listing does not constitute an endorsement of its accuracy or of the lister's ownership of the plate.
6. Buying and Selling Process
- 6.1 The Seller sets the asking price and may enable the "negotiable" option to receive purchase offers.
- 6.2 The Seller may receive up to five (5) purchase offers per plate and may accept the offer they consider suitable or reject all offers.
- 6.3 An offer submitted by a Buyer is a binding proposal for the duration of its validity as stated in the app.
- 6.4 The Seller's acceptance of an offer concludes the Transaction and binds both parties to complete it on the stated terms and within the stated periods.
- 6.5 Negotiations take place through in-app chat. Fared is not a party to the content of those conversations and does not warrant the accuracy of what is stated in them.
- 6.6 Both parties undertake to complete the Transaction exclusively through the Platform; agreeing to complete it outside the Platform is prohibited.
7. Auction Rules
- 7.1 Every auction has a defined closing time shown on the in-app countdown. Platform server time is the sole reference for calculating all periods.
- 7.2 A bid is binding and irrevocable; a bidder is obliged to complete the purchase if the plate is awarded to them.
- 7.3 Any bid placed within the final two minutes automatically extends the auction, preventing last-second sniping.
- 7.4 Bidder identity verification is required before a User may enter an auction, and proof of funds or a security deposit may be required as determined by the Platform.
- 7.5 The plate is awarded to the highest valid bidder when the period ends, and the winner is notified in the app.
- 7.6 The winner must pay the full transaction value within the period stated in the notice. On default, Fared may cancel the award, award the plate to the next bidder, suspend the defaulting account and claim compensation for the loss caused.
- 7.7 Fared may cancel any auction or exclude any bid tainted by manipulation, collusion or sham bidding, or affected by a technical fault, without any liability on its part.
- 7.8 Neither the Seller nor anyone connected to them may bid on their own plate to inflate the price.
8. Fees and Taxes
- 8.1 Platform fee: 3% of the plate value, due on completion of the Transaction.
- 8.2 Plate shipping fee: SAR 50 per Transaction.
- 8.3 The Seller and Buyer bear the platform and shipping fees as shown in the transaction summary in the app before confirmation.
- 8.4 Government transfer fee: SAR 1,030, borne by the Buyer alone, paid to the competent government authority. It does not accrue to Fared and is not refundable by Fared.
- 8.5 There is no charge for downloading the app, creating an account, publishing a Listing or browsing auctions.
- 8.6 Value Added Tax: Platform fees are subject to VAT at the statutory rate in force in the Kingdom, added to amounts due unless stated to be inclusive.
- 8.7 The User bears any bank transfer charges or commissions imposed by banks on their transactions.
- 8.8 Fared reserves the right to amend fees in future, provided the change is published on the Platform; it does not apply to Transactions concluded before it takes effect.
9. Escrow Payments and Disbursement
- 9.1 The Buyer transfers the full transaction value to the Platform's verified bank account shown in the app, and the amount is held in trust as security for both parties' rights.
- 9.2 The transfer must originate from a bank account in the Buyer's own name, with the transfer receipt attached in the app. Transfers from third-party accounts are not accepted.
- 9.3 The amount is released to the Seller only after confirmation that ownership transfer has actually been completed under Clause 10.
- 9.4 Proceeds are paid to a bank account in the Seller's own name; transfers to third-party accounts are not accepted.
- 9.5 No interest or return accrues to either party on amounts held.
10. Ownership Transfer
- 10.1 The procedure to transfer plate ownership to the Buyer's vehicle begins within a maximum of seventy-two (72) hours of payment confirmation.
- 10.2 The Buyer undertakes to complete the transfer through the Absher platform or any approved government channel, and to provide their vehicle registration and any required documents.
- 10.3 The Seller undertakes to cooperate with the transfer procedure and complete their part of it within the stated periods.
- 10.4 The time taken to complete the transfer is subject to the procedures and working hours of the competent government authorities, and Fared bears no liability for delays attributable to them.
- 10.5 Where the transfer cannot be completed for a reason not attributable to the Buyer, the full amount held is returned to them under Clause 11.
- 10.6 Risk in the plate and the legal responsibility attached to it pass to the Buyer from the date the transfer is officially completed with the competent authority.
11. Cancellation, Refunds and Right of Withdrawal
- 11.1 Either party may cancel before the Transaction is concluded — that is, before an offer is accepted or an auction is won — with no financial obligation.
- 11.2 After the Transaction is concluded, the Buyer is refunded in full where: the Seller fails to transfer ownership within the agreed period; the Seller is found not to own the plate; a legal impediment prevents transfer; or the Platform cancels the Transaction for a technical or legal reason.
- 11.3 Where the default is on the Buyer's side after their offer is accepted or they win an auction, Fared may deduct the platform fee as compensation for processing costs and refund the balance.
- 11.4 Where the default is on the Seller's side, Fared may claim the platform fee due on the Transaction, without prejudice to the Buyer's right to a full refund.
- 11.5 Refunds are made to the originating bank account, within the periods required by banking procedures.
- 11.6 The right of withdrawal established under the E-Commerce Law does not apply to services whose performance has actually begun with the User's consent, nor to ownership transfer procedures once completed with the competent government authority.
12. Prohibited Uses
The User is prohibited from any of the following; committing any of them is a material breach justifying immediate suspension of the Account:
- Listing plates they do not own, publishing false or misleading information, or impersonating others.
- Manipulating prices, placing sham bids, or colluding with other Users to influence auction outcomes.
- Attempting to complete a Transaction outside the Platform to avoid fees or escrow protection.
- Using the Platform for money laundering, terrorist financing or any unlawful purpose.
- Harassing other Users or sending abusive content or content contrary to law or public morals through chat.
- Posting commercial advertisements or third-party links within chats or Listings.
- Attempting to hack the Platform, circumvent its security measures, scrape its data, use automated bidding software, or disrupt its services by any means.
- Republishing the Platform's content or data, or using it commercially, without prior written permission.
- Any act criminalised by the Anti-Cyber Crime Law or any other law of the Kingdom.
13. Anti-Money Laundering and Identity Verification
- 13.1 Fared complies with the laws of the Kingdom relating to anti-money laundering and counter-terrorist financing, and applies customer verification procedures proportionate to the nature of its activity.
- 13.2 Fared may request additional documents to verify a User's identity or the source of funds, and may suspend a Transaction until they are provided.
- 13.3 Fared reserves the right to refuse or freeze any transaction and report it to the competent authorities where suspicion arises, without liability towards the User.
14. Intellectual Property and User Content
- 14.1 All intellectual property rights in the Platform — including the trade name, mark, logo, designs, interfaces, text, source code and databases — are owned by Fared and protected under the laws of the Kingdom.
- 14.2 The User is granted a personal, non-exclusive, non-transferable and revocable licence to use the Platform solely for the purposes permitted in this agreement.
- 14.3 The User retains ownership of the content they publish and grants Fared a non-exclusive, royalty-free licence to host, display and use it for the purposes of operating and promoting the Platform.
- 14.4 The User confirms that their content does not infringe third-party rights and bears sole legal responsibility for it.
15. Electronic Notices and Communications
- 15.1 The User consents to receiving notices and communications relating to their Account and Transactions through the app, SMS or email; these are recognised legal channels of notification.
- 15.2 A notice takes effect from the date it is sent to the latest contact details recorded on the Account, and the User bears the consequences of not keeping them current.
- 15.3 The Platform's electronic records — including login, offer, bid and chat records — constitute admissible evidence of transactions unless proven otherwise.
16. Suspension and Termination
- 16.1 Fared may suspend, restrict or close an Account on breach of these Terms, on suspicion of fraud, or at the request of a competent authority.
- 16.2 The User may terminate this agreement by deleting their Account at any time, without prejudice to their existing obligations under incomplete Transactions.
- 16.3 Termination does not extinguish rights either party acquired before it.
- 16.4 Provisions on liability, indemnity, intellectual property and dispute resolution survive termination.
17. Disclaimer of Warranties and Limitation of Liability
17.1 The Platform is provided "as is" and "as available". Fared exercises reasonable care to keep the service continuous and secure, without warranting that it will be free of interruption or technical error.
17.2 Fared does not guarantee that any plate will remain listed, that any particular price will be achieved, or that any User will wish to buy or sell.
17.3 Fared is not liable for: Users' conduct or breach of their obligations; the accuracy of the information they publish; agreements concluded outside the Platform; delays by government authorities or banks; or network outages and telecom provider failures.
17.4 Fared is in no event liable for indirect or consequential loss, including loss of profit, loss of opportunity and moral damages.
17.5 Fared's aggregate liability towards a User — on any basis whatsoever — is limited to the fees actually paid on the Transaction in dispute. This does not affect any liability that cannot lawfully be excluded.
18. Indemnity and Force Majeure
- 18.1 The User shall indemnify Fared and its personnel against any loss, claim, fine or expense arising from their breach of these Terms or of the law, or from their infringement of third-party rights.
- 18.2 Neither party is liable for a breach arising from force majeure or circumstances beyond its control, such as natural disasters, epidemics, government decisions, telecommunications or power outages, or cyber attacks.
- 18.3 Affected obligations are suspended for the duration of the force majeure event; if it continues for more than thirty (30) days, either party may terminate the affected Transaction without compensation.
19. General Provisions
- 19.1 Assignment: The User may not assign their rights or obligations under this agreement without Fared's written consent; Fared may assign them to any successor or affiliated entity.
- 19.2 Severability: If any provision of this agreement is held invalid, the remaining provisions remain valid and enforceable.
- 19.3 No implied waiver: Fared's forbearance in enforcing any of its rights is not a waiver of that right or of any other right.
- 19.4 Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between the parties and supersede any prior understandings.
- 19.5 Language: This agreement is issued in Arabic and English; in the event of any discrepancy in interpretation, the Arabic text prevails.
- 19.6 Headings: Clause headings are for guidance only and are not to be relied on in interpretation.
20. Amendments to These Terms
Fared reserves the right to amend these Terms at any time in line with the development of its services or with applicable law. The version number and last-updated date are published at the top of this page, and Users are notified of material changes through the app or by email. Continuing to use the Platform after an amendment takes effect constitutes acceptance of the updated version. Amendments do not apply retroactively to Transactions completed before they take effect.
21. Dispute Resolution and Governing Law
- 21.1 This agreement is governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
- 21.2 The parties shall seek to settle any dispute amicably within thirty (30) days of notice of it, through the Platform's support channels.
- 21.3 If amicable settlement is not reached, jurisdiction lies with the competent judicial authorities in the Kingdom of Saudi Arabia.
- 21.4 This does not affect a consumer's right to file a complaint with the competent regulatory authorities under applicable law.
